1. Who you are contracting with
Baphora ("Baphora", "we", "us") provides the Baphora service: a competitive poker decision-making game played against simulated opponents. By creating an account or continuing to use the service, you agree to these terms. If you use Baphora on behalf of an organisation, you confirm you have authority to bind it; otherwise you confirm you are of legal age in your country.
2. Your account
You must provide accurate information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity under your account. Guest sessions are temporary; only a registered account guarantees your progress is preserved.
3. Acceptable use
You must not misuse the service. In particular, you must not use it unlawfully, commit fraud or send spam, infringe intellectual property rights, or interfere with security (including malware, probing, automated scraping, or automating gameplay to farm XP or ratings). Baphora is a skill game — it does not offer real-money gambling and no winnings of monetary value are awarded.
4. Intellectual property and licence
Baphora retains ownership of the service, its software, game engine, content and branding. We grant you a limited, non-exclusive, non-transferable right to use the service within your selected plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits such as daily play caps.
5. Service availability
We work to keep Baphora available, but we do not guarantee uninterrupted or error-free performance. Features, difficulty balancing, rating formulas and limits may change as the product evolves.
6. Payments and subscriptions
Baphora Pro is a recurring subscription billed every 4 weeks at the price shown at checkout. Payment, billing, currency, tax, cancellation and refund mechanics are handled by our reseller. See Paddle's Buyer Terms and our Refund Policy. Your subscription renews automatically until cancelled; when you cancel, Pro access remains until the end of the period you already paid for.
7. Reseller / Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination your right to use the service ends; you may request an export of your account data before deletion.
9. Warranties and liability
To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect, consequential or special damages, including loss of profits, data or goodwill. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing excludes liability for fraud, death or personal injury where the law does not permit it.
10. Indemnity, law and changes
You indemnify Baphora against claims arising from your unlawful use of the service or your breach of these terms. These terms are governed by the laws of the seller's jurisdiction, and disputes are subject to its courts. We may update these terms; continued use after an update means you accept the revised version.
